This new Phantom Surfers album contains all original compositions with some of the mort beloved titles from the worlds of music, film and literature. You see, in copyright law, titles of works - such as books, songs, or movies - cannot be copyrighted. This principle exists because titles are generally considered too short and lacking in the originality required for copyright protection. Copyright law is designed to protect "original works of authorship fixed in a tangible medium." However, for a work to qualify, it must exhibit a minimal level of creativity and originality (by the way, minimal level of creativity and originality is the Phantom Surfers' motto). A title, by itself, does not meet this threshold. For example, titles like "Gone with the Wind" or "Jailhouse Rock" may be strongly associated with specific works, but the phrases themselves are not protected by copyright.
